Band Performance Terms

These terms outline the expectations and standard arrangements for live musical performances at the Bellemont Farm Sunflower Festival , located on Valley Road in Hopewell Township, New Jersey (“Venue”). By showing up to perform, Band accepts these Terms.

1. Date, Time, and Location

Shows take place at the Venue at dates and times agreed upon between the Operator and the Band. Bands are expected to arrive in advance for setup and sound check. Check your time and date on our schedule to be sure it is correct.

2. Description of Show

Performances consist of live musical sets determined by the Band in consultation with the Operator. Sets typically last 90 minutes.

3. Compensation

Payment terms are determined in advance and agreed upon between the Band and the Operator. Payment is made by check or Zelle after the show. If payment is by check, it will be sent out within 5 business days following the show. If by Zelle, within 48 hours after the performance.

4. Cancellation

The Operator may cancel a Show up to seven days prior to the scheduled date without penalty. If Operator cancels the show with less than seven days’ notice (other than for weather, see below), it will pay a 50% cancellation fee to the Band.

5. Force Majeure

If a Show cannot take place due to unforeseen circumstances beyond the control of either party (e.g., acts of nature, government action, illness), both parties will attempt to reschedule under the same terms. No payment is required in such cases.

6. Weather

As the Venue is outdoors, all Shows are subject to weather conditions. In the event the Show is canceled due to severe weather, the Operator may cancel the performance without liability. If cancellation occurs after the Band has arrived or partially prepared, the Operator agrees to pay a cancellation fee of 50% of the agreed performance fee to compensate the Band for time, travel, and preparation.

7. Hospitality

The Operator provides reasonable refreshments, such as bottled water, during performances.

8. Tips

Bands may use tip jars and encourage audience tipping. All tips belong exclusively to the Band.

9. Merchandise

Bands may sell their own merchandise, including recordings, apparel, and related items, at the Venue during Shows.

10. Promotion

Bands are encouraged to promote Shows on their own websites and social media, acknowledging Bellemont Farm and the Lambertville Sunflower Festival as the organizer. During performances, Bands should thank sponsors and highlight their support.

11. Equipment

Band is responsible for its own equipment. Operator is not responsible for loss, theft, or damage to Band property, except in cases of gross negligence.

12. Dispute Resolution

Disputes arising from or related to performances are intended to be resolved through binding arbitration in New Jersey under the rules of the American Arbitration Association.

13. Governing Law

These terms are governed by the laws of the State of New Jersey.

14. Severability

If any provision is found invalid or unenforceable, remaining provisions remain in full effect.
